Agreement
These Terms of Use govern your use of ArtAlbum. By downloading, accessing, or using ArtAlbum, you agree to these Terms and to any App Store terms that apply to your download or purchase.
If you do not agree to these Terms, do not use ArtAlbum.
What ArtAlbum Provides
ArtAlbum is a personal art journal for capturing or uploading artwork photos, scanning labels, identifying artworks, saving notes, organizing entries, and browsing your collection through album, map, and calendar views.
ArtAlbum is intended for personal organization, learning, and discovery. It is not an authentication, appraisal, provenance, copyright, or professional art advisory service.
Your Content
You are responsible for the photos, labels, notes, location details, and other content you add to ArtAlbum. You should only upload content you have the right to use and process through the app.
You keep your rights to your content. You grant ArtAlbum permission to process, store, display, and transmit your content as needed to provide and improve the app.
Artwork Identification and Generated Details
ArtAlbum may use photo analysis, label text, location context, and public art information to identify artworks or generate descriptions. Results may be incomplete, inaccurate, or based on uncertain matches.
You should review important details before relying on them. ArtAlbum may show confidence levels, source labels, or other context to help you evaluate scan results.
Subscriptions and Purchases
Some ArtAlbum features may require a paid subscription. Purchases and subscription management for the iOS app are handled through Apple and your App Store account.
Subscription terms, renewal, cancellation, refunds, and billing are governed by Apple’s applicable App Store terms. You can manage or cancel subscriptions through your App Store account settings.
Acceptable Use
- Do not use ArtAlbum to upload illegal, harmful, abusive, or infringing content.
- Do not attempt to disrupt, reverse engineer, overload, or misuse the app or related services.
- Do not use ArtAlbum to make misleading claims about artwork authenticity, ownership, provenance, or valuation.
- Do not use automated systems to access the service in a way that interferes with normal operation.
Intellectual Property
ArtAlbum, including its design, software, branding, and related materials, is protected by intellectual property laws. These Terms do not grant you ownership of ArtAlbum or its underlying technology.
Artwork images, museum labels, and third-party materials may be protected by their own rights. You are responsible for respecting those rights when capturing, uploading, storing, or sharing content.
Third-Party Services and Content
ArtAlbum may rely on third-party services for hosting, storage, subscriptions, scanning, identification, maps, diagnostics, or other app functions. Those services may have their own terms and privacy practices.
The app may reference public artwork information, museum sources, or external materials. ArtAlbum does not control third-party content and is not responsible for its accuracy or availability.
Changes and Availability
We may update, add, remove, suspend, or discontinue features at any time. We may also update these Terms when the app, legal requirements, or business needs change.
We aim to keep ArtAlbum reliable, but we do not guarantee uninterrupted or error-free access.
Disclaimers
ArtAlbum is provided on an as-is and as-available basis. To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted operation.
Limitation of Liability
To the maximum extent permitted by law, ArtAlbum and its operators will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, or other intangible losses arising from your use of the app.
Termination
You may stop using ArtAlbum at any time. We may suspend or limit access if we believe these Terms have been violated or if needed to protect the app, users, or service providers.
Governing Terms
These Terms apply except where local consumer protection laws give you additional rights. For App Store downloads and purchases, Apple’s applicable terms also apply.
